How Long Does Trademark Registration Take in India?

Short answer: if your application is unopposed and unobjected, expect a certificate in roughly 6–12 months. If it’s objected to or opposed, it typically takes 18–24 months, owing to Registry backlog. Government stages are outside anyone’s control, so no timeline — including this one — is guaranteed.

Why the range is so wide

Trademark registration in India runs through the Registrar of Trademarks (IP India) under the Trade Marks Act, 1999. The process has several stages, and each one can add time:

  1. Trademark search — a quick internal step before filing.
  2. Filing (Form TM-A) — instant; you get an application number immediately and can start using ™.
  3. Examination — the Registry reviews the mark and issues an Examination Report.
  4. Objection reply (if raised) — you must respond within 1 month (30 days), extendable up to two further months.
  5. Show cause hearing (if needed) — scheduled if your reply doesn’t fully satisfy the examiner.
  6. Advertisement — accepted marks are published in the Trade Marks Journal.
  7. Opposition window — 4 months during which any third party may oppose. If opposed, a counter-statement is due within 2 months (no extension), followed by evidence stages and a hearing.
  8. Registration & certificate — issued once the mark clears all the above.

What actually determines your timeline

Whether your mark faces an objection or opposition is the single biggest factor. A distinctive mark in a class with no close prior marks is far more likely to sail through in the faster window; a generic or descriptive mark, or one similar to an existing registration, is more likely to face an examiner’s objection or a third party’s opposition.
